This is an application for bail moved on behalf of the applicant Dhirender alias Dhiraj indicted in case crime No. 446 of 2006 under sections 25 Arms Act P.S. Sikandra District Agra. . Heard Shri Ravindra Nath Rai, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the recovery of two revolvers of .38 bore and four pistols made in England and U.S.A. is said to have been made from the possession of the applicant. The learned counsel argued that there are no public witnesses to the recovery and applicant is not a man of criminal antecedents.
The learned A.G.A. argued that the recovery of foreign made revolver and pistols was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. There are no public witnesses to the recovery. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Dhirender alias Dhiraj indicted in case crime No. 446 of 2006 under sections 25 Arms Act P.S. Sikandra District Agra , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
