This is an application for bail moved on behalf of the applicant Kallu alias Kalua involved in case Crime No. 69 of 2006 under sections 394 I.P.C. Police station Mirhanchi, district Etah.
Heard Sri Rajeev Chaddha, Advocate, holding brief of Sri Manoj Singh, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is not named in the first information report and his name came to fore from the confessional statement of co-accused. The learned counsel urged that no test identification parade was conducted. According to the learned counsel no recovery of looted jewellery and cash was made from the possession of the applicant.
The learned AGA argued that there is criminal history of 11 cases against the applicant and the applicant is said to have opened fire at the victim.
I have taken into consideration the submissions advanced on behalf of both the parties.
No recovery of looted property was made from the possession of the applicant. No test identification was conducted. The applicant is not named in the first information report. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Kallu alias Kalua involved in case Crime No. 69 of 2006 under sections 394 I.P.C., Police station Mirhanchi, district Etah, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
