Heard learned Counsel for the applicant, learned A.G.A.
It is submitted by learned counsel for the applicant that from the side of applicant Harveer Singh lodged the F.I.R. in case crime no, 277 of 2004, under Setions 147, 148, 307 I.P.C. in which the charge sheet has been submitted and the case has been committed to the court of Sessions, but in respect of the same incident an application under Sections 156(3) Cr. P. C. moved by Satya Veer. The same was allowed and the F.I.R. has been registered against the applicant and other co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Omvir involved in Case Crime No. C-9 of 2004, under Sections 147, 148, 149, 302 and 307 I.P.C, Police Station Aurangabad, District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
