This is an  application for bail moved on behalf of the applicant Ravi Shankar Shahu   indicted in case crime No. 247  of  2006 under sections 272, 273, 420, 467, 468  I.P.C. P.S. Babu Purwa  District Kanpur Nagar .

Heard Shri Mohd. Nizam Uddin, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted  co-accused Subhash Chandra Sahu who is owner of the business establishment has been enlarged on  bail by an order of this court dated 4.8.2006 passed in Criminal Misc. Bail Application No. 15943 of 2006. The learned counsel submitted that applicant being an employee of co-accused Subhash Chandra Sahu was obeying his instructions while pouring oil in the containers. The learned counsel pointed out that there is no report of public analyst to establish that recovered edible oil is spurious and injurious to health.

The learned A.G.A. argued that applicant is involved in the case of manufacturing spurious edible oil.

I have taken into consideration the submissions advanced on behalf of both the parties.

The co-accused Subhash Chandra Sahu has been enlarged on bail by an order of this court dated 4.8.2006. The applicant being an employee of  co-accused Subhash Chandra Sahu and his case stands on better footing.In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Ravi Shankar Shahu   indicted in case crime No. 247  of  2006 under sections 272, 273, 420, 467, 468  I.P.C. P.S. Babu Purwa  District Kanpur Naga , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
