This is an application for bail moved on behalf of the applicant Ravindar Kumar Singh Yadav involved in case Crime No. 197 of 2004 (Criminal Case No.  3596 of 2004) under section 406 I.P.C.  Police station Manda, district Allahabad.

Heard Sri Rakesh Prasad, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that the applicant has been falsely implicated at the behest of village pradhan and the complainant filed an affidavit before the Circle Officer, Meja, district Allahabad. The learned counsel argued that the salary of the applicant was detained during the period September 2004 to February 2005 but on giving satisfactory explanation the salary has been released. The learned counsel submitted that the applicant is a government servant and false and fabricated story has been concocted against him.

The learned AGA argued that the applicant in his capacity as Gram Vikas Adhikari misappropriated the amount of Rs. 10,000/- entrusted to him by the complainant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The offences are triable by the Magistrate Ist class. The complainant filed an affidavit on 23.9.2004 before the Circle Officer, Meja, district Allahabad stating therein that the amount was withdrawn by himself and first information report was lodged at the instigation of the villagers. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Ravindar Kumar Singh Yadav involved in case Crime No. 197 of 2004 (Criminal Case No.  3596 of 2004) under section 406  I.P.C.  Police station Manda, district Allahabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
