This is an application for bail moved on behalf of the applicant Sonu indicted in case crime No. 116 of 2006 under sections 307, 394, 411 I.P.C. P.S. Nagal District Sharanpur.
Heard Shri Anurag Pathak, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that there has been heated exchange between the informant and applicant over the felling of motorcycle of which applicant was riding and the complainant falsely implicated him on that score.
The learned A.G.A. argued that the applicant and co-accused snatched mobile and cash of Rs. 500/- from the complainant and captured by the villagers at the spot and recovery of looted cash of Rs. 500/- was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
This is a case of no injury. The recovery of cash of Rs. 500/- is said to have been made from the possession of the applicant.The recovered cash of Rs. 500/- does not bear any identifying marks. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Sonu indicted in case crime No. 116 of 2006 under sections 307, 394, 411 I.P.C. P.S. Nagal District Sharanpur , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
