This is an application for bail moved on behalf of the applicants Tulsi, Roshni and Julee indicted in case crime No. 17 of 2006 under sections 379, 411 I.P.C. P.S. G.R.P. Muzaffar Nagar District Muzaffarnagar. .
Heard Shri P.S. Pundir, learned counsel for the applicants, learned A.G.A. and have perused the record.
The learned counsel for the applicants submitted that applicants are said to have pick pocketed Rs. 685/- from the pocket of the complainant.
The learned A.G.A argued that recovery of stolen currency notes was made from possession of the applicants who were arrested at the spot.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. There is no criminal history of the applicants as stated in paragraph- 9 of the affidavit filed in support of the bail application. In view of these facts, I consider it to be a fit case for bail.
Let the applicants Tulsi, Roshni and Julee indicted in case crime No. 17 of 2006 under sections 379, 411 I.P.C. P.S. G.R.P. Muzaffar Nagar District Muzaffarnagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
