Bhagi & Another v. State Of U.P. Thru' Collector, Varanasi & Others - WRIT - C No. 44686 of 2006 RD-AH 13834 (21 August 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel for the petitioners.
Petitioners, aggrieved by an order passed by the Assistant Collector dated 7th January 2005 whereby the petitioners have been held to be unauthorized occupants on the land in dispute which vests in Gaon Sabha and have been directed to be evicted and pay compensation of Rs.1,000/-, approached revisional court. The revisional court after considering the case of the petitioners dismissed the revision. The findings recorded by the Assistant Collector is affirmed by the revisional court that the petitioner is in unauthorized occupation of the land in dispute which is recorded as Banjar and vests in the Gaon Sabha. These concurrent findings have not been demonstrated to be either perverse or suffering from error of law which may warrant interference by this Court under Article 226 of the Constitution of India.
Thus the writ petition has no force and is accordingly dismissed.
