This appeal has been preferred by Bhoore, Narendra, Hari Kishan and Kedar against the judgement and order dated 5.8.2006 passed by Addl. District and Sessions Judge, Court No. 6 Moradabad in S.T. No. 752 whereby the appellants have been found guilty and convicted under Sections 323, 308, 504/34 IPC and sentenced to undergo rigorous imprisonment up to three years.
Heard Dr. G.S.D. Mishra, learned counsel for the appellants and learned A.G.A.
The contention of the learned counsel for the appellants is that prosecution case is not consistent and three versions have been taken in the matter.
In the circumstances of the case, but without prejudice to the merits of the case, appellants be released on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
They shall also give an undertaking that they will not indulge in any criminal activity or anti social activity and if any report is found against them, it shall be open for the court below to report to this Court so that their bail may be cancelled.
