This is an application for bail moved on behalf of the applicant Chet Ram alias Chandra Pal indicted in case crime No. 409-C of 2006 under sections 147, 498-A, 323, 504, 506 I.P.C. and section 3/ 4 of Dowry Prohibition Act P.S. Noorpur District Bijnor.
Heard Shri Rajeev Sisodia, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted suit for restitution of conjugal rights was instituted by applicant on 21.9.2005. The learned counsel submitted that after service of notices of the said suit the victim and her father entered into compromise and articles given at the time of marriage were returned. The learned counsel for the applicant argued that the girl was not residing at her marital home since the very beginning of the marriage.
The learned A.G.A. argued that applicant is the husband and allegation of subjecting the victim to assault have been made against him.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant instituted the suit for restitution of conjugal rights on 21.9.2005. The injuries are of simple nature. The First Information Report was registered in compliance of order passed in application under section 156 (3) Cr.P.C. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Chet Ram alias Chandra Pal indicted in case crime No. 409-C of 2006 under sections 147, 498-A, 323, 504, 506 I.P.C. and section 3/ 4 of Dowry Prohibition Act P.S. Noorpur District Bijnor , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
