This is an application for bail moved on behalf of the applicant Ghoshi indicted in case crime No. 367 of 2006 under sections 3/ 4 of Gambling Act and 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S. Kotwali District Mathura.
Heard Shri Rajesh Kumar Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that in the gang chart five cases have been shown against the applicant out of which he has been acquitted in crime case no. 124 of 2001 and rest of the cases are not pending.
The learned A.G.A. argued that applicant is a habitual gambler and in case he is released on bail he will commit similar offences.
Having taken into consideration the submissions advanced on behalf of both the parties and without expressing any opinion on merits of the case, I consider it to be a fit case for bail.
Let the applicant Ghoshi indicted in case crime No. 367 of 2006 under sections 3/ 4 of Gambling Act and 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S. Kotwali District Mathura , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
