This is an  application for bail moved on behalf of the applicant Isuf  indicted in case crime No. 732  of 2004  under sections420, 467, 468, 471  I.P.C. P.S. Sehani Gate  District Gahaziabad .

Heard Shri M.L Rai , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that account opening form was presented by Bhupendra Singh Field Officer.The learned counsel submitted that co-accused Sunil Kumar who had accompanied Bhupendra Singh and identified Satish Kumar Bajaj has been enlarged on bail by the trial court. The learned counsel submitted that applicant had neither introduced nor identified the person in whose name the account was opened. The learned counsel contended that main accused Bhupendra Singh has obtained  stay of his arrest from this court.

The learned A.G.A. argued that applicant in his capacity as clerk of Maha Medha Urban Cooperative Bank Noida had filled account opening form and had signed it.

I have taken into consideration the submissions advanced on behalf of both the parties.

The account was got opened by Bhupendra Singh, Field Officer. The co-accused Sunil Kumar has identified the person in whose name the account was opened. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Isuf  indicted in case crime No. 732  of 2004  under sections420, 467, 468, 471  I.P.C. P.S. Sehani Gate  District Gahaziabad  , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
