This is an  application for bail moved on behalf of the applicants Jeetu and Shahid   indicted in case crime No. 52  of 2006  under sections  406, 420 I.P.C. 3/7 of Essential Commodities Act P.S. Rizor  District Etah.

Heard Shri S.K. Mishra, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicants submitted that co-accused Vimal and Naim have been enlarged on bail by an order of this court dated 17.8.2006 passed in Criminal Misc. Bail Application No. 15591 of 2006 and the case of the applicants is similar to that of co-accused. The learned counsel argued that applicants were driving the trucks in which the wheat was loaded by Senior Marketing Inspector.

The learned A.G.A. argued that the wheat recovered from the trucks belonged to F.C.I. and was being carried to sale in the open market.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicants were drivers of the trucks over which wheat was loaded. The wheat was loaded by Senior Marketing Inspector. The co-accused Vimal and Naim have been enlarged on bail by an order of this court dated 17.8.2006 In view of these facts, I consider it to be a fit case for bail.  

Let the applicants Jeetu and Shahid   indicted in case crime No. 52  of 2006  under sections  406, 420 I.P.C. 3/7 of Essential Commodities Act P.S. Rizor  District Etah. , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
