This is an  application for bail moved on behalf of the applicants Jumedin and Bani   indicted in case crime No.165  of 2006  under sections 308, 323, 324, 325, 452, 504, 506   I.P.C. P.S. Vrindavan  District Mathura.

Heard Shri Ajay Kumar Singh, learned counsel for the applicants, learned A.G.A.  and have perused the record.

The learned counsel for the applicants submitted that  four co-accused persons are said to have subjected the injured to assault by wielding of  lathis, sticks and farsha but one injured sustained head injury. The learned counsel pointed that there is no specific allegation as to by which of the accused  head injury was caused. The learned counsel contended that there is a cross case  the First Information Report of which was registered on 24.4.2006 and two persons from the side of the applicants sustained injuries  and were medically examined on 24.4.2006.

The learned  A.G.A. argued that applicants and co-accused subjected the injured to assault and caused head injury.

I have taken into consideration the submissions advanced on behalf of both the parties.

One injured sustained head injury about which it is not clear as to  which of the accused caused said injury. In view of these facts, I consider it to be a fit case for bail.  

Let the applicants Jumedin and Bani   indicted in case crime No.165  of 2006  under sections 308, 323, 324, 325, 452, 504, 506   I.P.C. P.S. Vrindavan  District Mathura , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
