We have heard learned counsel for the appellant and learned A.G.A. for the State. We have gone through the judgment under appeal.
Office is directed to summon the trial court record within a period of six weeks.
It is contended that the appellant and his brother have been assigned the role of exhortation to co-accused (Anupam). The appellant did not cause any injury to the deceased (Sita Ram).
In view of the role assigned to the appellant in the offence in question, we are inclined to release the appellant on bail during pendency of appeal.
Let the appellant-Ram Babu be enlarged on bail during pendency of appeal on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.M.M., Kanpur Nagar in S.T. No. 244 of 2005 State Vs. Anupam Sachan and others.
If the appellant deposits a sum of Rs.5,000/- as fine in the court below within a period of one month from today, the recovery of remaining amount of fine shall remain stayed.
