It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant and co-accused Ram Narain and Ram Bahori Kevat came into light. No stolen property has been recovered from the possession of the applicant. Co-accused Ram Narain Kurmi and Ram Bahori Kevat whose cases are on the same footing with the case of th applicant have been released on bail by this court on 12.7.2005 and 16.11.2005 in Criminal Misc Bail Applications No. 12512 of 2005 and 21327 of 2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shyam Sundar involved in Case Crime No. 184 of 2005, under Sections 302 and 392 I.P.C. Police Station Kotwali , District Banda be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
