This appeal has been preferred by Suresh Chandra, Kamlesh, Man Singh, Tulsi Ram against the judgement and order dated 31.7.2006 passed by Special Judge (D.A.A.), Banda in S. T. No. 2 of 1994 whereby the appellants have been found guilty and convicted under Sections 332, 353 IPC and sentenced to under go rigorous imprisonment up to two years and fine has also been imposed on them.
Heard Sri P. K. Singh, learned counsel for the appellants and learned A.G.A.
The contention of the learned counsel for the appellants is that appellants are on interim bail from the trail court.
In the circumstances of the case, but without prejudice to the merits of the case, appellant shall continue on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. They shall deposit the amount of fine as imposed on them.
They shall also give an undertaking that they will not indulge in any criminal activity or anti social activity and if any report is found against them, it shall be open for the court below to report to this Court so that their bail may be cancelled.
