This is an application for bail moved on behalf of the applicant Pappu indicted in case crime No. 758 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Bilari District Moradabad.
Heard Shri R.K. Verma, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that in the gang chart two cases under sections 307 and 411 I.P.C. have been shown against the applicant and applicant is on bail in both the cases.
The learned A.G.A. argued that applicant is a member of gang involved in commission of theft of electric wire and in case he is enlarged on bail, he will commit other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in both the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Pappu indicted in case crime No. 758 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Bilari District Moradabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
