It is submitted by learned counsel for the applicant that according to F.I.R. version the role of causing injuries is assigned to the applicant and two other co-accused person, but during investigation it has been specifically alleged that the applicant's shot hit the deceased. It is further improvement and co-accused Manu whose case is on the same footing according to the F.I.R. with case of the applicant has been released on bail by this court on 10.7.2006 in Crl Misc Bail Application No. 13110 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sanjai Yadav involved in Case Crime No. 163 of 2006, under Sections 302, 201, 504, 34 I.P.C. Police Station Kalyanpur, District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
