This is an application for bail moved on behalf of the applicant Shiv Mangal Singh indicted in case crime No. 91 of 2006 under section 25 Arms Act P.S. Sisolar District Hamirpur.
Heard Shri A.K. Singh, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that recovery of country made pistol of .315 bore and live cartridge of .315 bore is said to have been made from the possession of the applicant.
The learned A.G.A. argued that applicant is previous convict for an offence under section 302 I.P.C.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offence is triable by the Magistrate Ist class. There are no public witnesses to the recovery. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Shiv Mangal Singh indicted in case crime No. 91 of 2006 under section 25 Arms Act P.S. Sisolar District Hamirpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
