This is an application for bail moved on behalf of the applicant Bhulla indicted in case crime No. 149 of 2006 under sections 135 and 138 Electricity Act, 2003 P.S. Jawan District Aligarh.
Heard Shri Sudhir Dixit, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the electric connection is in the name of applicant's father. The learned counsel urged that no cognizance of offences punishable under the Electricity Act can be taken on the basis of First Information Report. According to learned counsel criminal complaint is to be filed in relation to the offence under the Act.
The learned A.G.A. argued that the applicant and his father were found committing theft of electric energy for running their tube-well.
I have taken into consideration the submissions advanced on behalf of both the parties.
The cognizance for the offence punishable under the Electricity Act can be taken on the basis of complaint as contemplated under section 151 of Electricity Act.In view of these facts, I consider it to be a fit case for bail.
Let the applicant Bhulla indicted in case crime No. 149 of 2006 under sections 135 and 138 Electricity Act, 2003. P.S. Jawan District Aligarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
