Heard learned counsel for the petitioner Sri S.P. Singh and the learned standing counsel for the respondents.
With regard to the fact that respondent no.7 has exceeded his mining area, a report was called for and the report given by Up Ziladhikari, Ghaziabad dated 13.12.2005 and thereafter the report dated 16.12.2005 submitted by the Joint Committee, Geologist and Surveyor, Ghazaibad, according to the petitioner, all the reports are in favour of the petitioner and in spite of that the District Magistrate has not initiated any action. The petitioner has already made representations Annexures- 11 to 13 to the writ petition.
In view of the aforesaid fact as in spite of the representations filed by the petitioner, the respondents have not taken any action and has not passed any order, it is, therefore, provided that in case the petitioner makes an application annexing certified copy of the order before respondent no.2 within a period of one week, respondent no.2 District Magistrate, Ghaziabad is directed to consider the report of the petitioner taking into consideration the reports dated 13.12.2005 and 16.12.2005 respectively. The respondent no.2 is further directed to pass the appropriate orders according to law after recording reasons within a period of one month thereafter.
With these directions the writ petition is disposed of.
