This is an  application for bail moved on behalf of the applicants Deepak and Rupin   indicted in case crime No. 73  of 2006 under sections 136 Electricity Act and section 379, 411  I.P.C. P.S. Niwari  District Ghaziabad.

Heard Shri Raj Kumar, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicants submitted that discovery of stolen wire is said to have been made in pursuance of the joint statement of the applicants and co-accused. The learned counsel urged that there is no criminal history of the applicants.

The learned A.G.A. argued that the theft of electric wire was committed between 10/11-6-2006 and recovery was made on 14.7.2006 at the pointing out of the applicants and co-accused.

I have taken into consideration the submissions advanced on behalf of both the parties.

The recovery of stolen wire having been made in pursuance of the joint statement of the applicants and co-accused, I consider it to be a fit case for bail.  

Let the applicants Deepak and Rupin   indicted in case crime No. 73  of 2006 under sections 136 Electricity Act and section 379, 411  I.P.C. P.S. Niwari  District Ghaziabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
