Heard learned counsel for the appellant and learned A.G.A on the prayer for bail.
Summon the trial court record within three weeks.
It is a case of circumstantial evidence. Even the panchas were not available to identify the dead body. The only evidence against the appellant is that of extra judicial confession which has been retracted. The chain of the circumstances is not complete.
Considering all the facts and circumstances of the case, we are of the view that appellant Krishna Autar alias Mama is entitled to be released on bail . Let appellant Krishna Autar alias Mama convicted under sections 302/34 and 201 IPC and sentenced thereunder in Sessions Trial no. 86 of 1996 ( State Vs. Munshi Lal & others) be released on bail during the pendency of appeal on his executing a personal bond and furnishing two reliable sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate, Jalaun at Orai.
The C.J.M, Jalaun at Orai , shall send photocopies of personal and surety bonds executed and furnished by and on behalf of the accused- appellant to this Court soon thereafter.
