This is an application for bail moved on behalf of the applicant Digvijay alias Lamboo indicted in case crime No. 813 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Saidpur District Gazipur.
Heard Shri Brij Raj, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that in the gang chart one case has been shown against the applicant in which he has been granted bail by an order of this court dated 10.8.2006 passed in Criminal Misc. Bail Application No. 16311 of 2006 .
The learned A.G.A. argued that applicant being involved in a case of murder and in case he is enlarged on bail, he will commit other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in the single case shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Digvijay alias Lamboo indicted in case crime No. 813 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Saidpur District Gazipur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and subject to an undertaking that he will not misuse the liberty of bail by indulging in antisocial activities and commission of other offences.
