This is an  application for bail moved on behalf of the applicants Deepak and Rupin   indicted in case crime No. 54  of 2006 under sections 136 Electricity Act and section 379, 411  I.P.C. P.S. Niwari  District Ghaziabad.

Heard Shri Raj Kumar, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicants submitted that recovery of 70 meters electric wire is alleged to have been made from the open place at the pointing out of the applicant and two co-accused. The learned counsel urged that there is no criminal history of the applicants.

The learned A.G.A. argued that recovery of stolen electric wire is said to have been made from the possession of the applicants.

I have taken into consideration the submissions advanced on behalf of both the parties.

This being a case of joint recovery, I consider it to be a fit case for bail.  

Let the applicants Deepak and Rupin   indicted in case crime No. 54  of 2006 under sections 136 Electricity Act and section 379, 411  I.P.C. P.S. Niwari  District Ghaziabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
