We have heard Sri S.R.Verma, learned counsel for the petitioners, Sri Ravindra Singh, Advocate for the respondent No.4, Sri Arvind Srivastava, Advocate for the respondent No.3 and learned Standing Counsel for the respondent Nos. 1,2, 5 and 6.
It has been submitted by the learned counsel for the petitioners that Civil Suit is pending before the learned Civil Judge (II), Mathura and an injunction order has already been granted in favour of the petitioners on 7.12.1991 but in spite of the pendency of the suit a recovery certificate has been issued against the petitioners for recovery amounting to Rs.3,05,86,817/-
As the Civil Suit filed by the petitioners is still pending for the dispute which is involved in the present writ petition, as such, it is open to the petitioners to make an application before the Civil Court.
In view of the aforesaid fact, the writ petition is not maintainable and is hereby dismissed.
There shall be no order as to costs.
