This is an application for bail moved on behalf of the applicant Dilip Singh Rajawat indicted in case crime No. 160 of 2006 under sections 41 Cr.P.c. and 413 I.P.C. P.S. G.R.P. District Kanpur Nagar.
Heard Shri P.K. Singh , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that briefcase containing articles has been planted by the police. The learned counsel argued that applicant came to Kanpur to visit his maternal uncle. According to learned counsel there is no criminal history of the applicant.
The learned A.G.A. argued that recovery of stolen suitcase containing identity card bearing the name of Navraj Kaji and other articles was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class.The applicant is in jail for the last about one month. There is no criminal history of the applicant.In view of these facts, I consider it to be a fit case for bail.
Let the applicant Dilip Singh Rajawat indicted in case crime No. 160 of 2006 under sections 41 Cr.P.c. and 413 I.P.C. P.S. G.R.P. District Kanpur Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
