It is contended by Sri Ajay Sengar, counsel for the revisionist that for one incident two complaints were file; one by the opposite party no.2 and another by her husband, opposite party no.3. The Additional Sessions Judge/F.T.C.-2, Jalaun at Oriai, without considering the aspect and properly examining the record, allowed the revision and remanded the case to the Judicial Magistrate concerned with certain directions.
Issue notice to the opposite party no. 2 to file counter affidavit within six weeks. A.G.A. may also file counter affidavit within the aforesaid period. Two weeks thereafter for rejoinder affidavit.
List on 21st April, 2006.
Till 31st July, 2006 operation of the order dated 9.12.2005 passed by Additional Sessions Judge/F.T.C.-2, Jalaun at Oriai in criminal revision no. 69 of 2005 and criminal revision no. 70 of 2005 shall remain stayed.
