Heard learned Counsel for the applicant and learned A.G.A. and Sri S.N. Singh learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During the investigation the name of the applicant came into light and thereafter, on 21.3.2006 at his pointing out a iron rod used in the commission of the offence was recovered from a water channel. The recovery was not supported by any independent witness. The place of the recovery was an open place which was easily accessible by the other persons. There is no other evidence against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Bilas involved in Case Crime No. 52 of 2006, under Sections 302 and 307 I.P.C. Police Station Sonha, District Basti be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
