According to the petitioner, she had constructed the house on the land in question after having purchased it in the year 1994. The map was sanctioned, the electric connection has also been sanctioned and she is peacefully residing in her own house. However, the respondent no. 3 is proposing to demolish the said building without assigning any reasons. The petitioner has also filed her detailed objections before the Home Secretary, Government of U.P., Lucknow sent by registered post on 16th August, 2006 with its copy endorsed to the Executive Engineer, Public Works Department for action.
Taking into consideration the entire facts and circumstances of the case, the writ petition is disposed of with a direction to the respondent no. 3 to pass appropriate orders in accordance with law on the aforesaid objection filed by the petitioner within one month from the date a certified copy of this order along with the objections are filed before him. The petitioner would be at liberty to produce supporting documents before the respondent no. 3 along with the application with which she file the copy of the order.
For a period of six weeks, status quo with regard to the property in question shall be maintained by the respective parties.
It is made clear that this Court has not adjudicated the case on merits.
