Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that the alleged occurrence had taken place in a sudden quarrel. It was not pre-intended . It is said that the applicants and other co-accused causes injuries by using lathi and danda blows. Consequently, two persons received injuries, in which one of the injured died subsequently. Co-accused Nanku has been released on bail by this court on 10.8.206 in Criminal Misc Bail Application No. 16409 of 2006. the case of the applicants is on the same footing with co-accused Nanku.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicant Pappu alias Rudra Pal Lodhi and Bhoop Lodhi involved in Case Crime No. 33 of 2006, under Sections 323, 504 and 304 I.P.C., Police Station Thariyawan District Fatehpur be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
