This is an  application for bail moved on behalf of the applicant Raju Mishra   indicted in case crime No.87  of 2005  under sections 307, 387, 506   I.P.C. , 10/12 of Dacoity Affected Area Act and 7 Criminal Law Amendment Act P.S.Bisanda  District Banda.

Heard Shri Rajesh Kumar Singh, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that it is a case of no injury. According to learned counsel co-accused Lalji Pandey, Kailash Mishra, Ram Naresh alias Bos and Chhota have been enlarged on bail by the orders of this court dated 21.10.2005, 21.9.2005 and 12.9.2005 passed in Criminal Misc. Bail Application numbers 20020 of 2005, 17290 of 2005 and 17351 of 2005 and the case of the applicant is identical  to that of co-accused.

The learned A.G.A. argued that applicant and co-accused made extortion of demand of Rs. 50,000/- and opened fire which unluckily did not hit the complainant.

I have taken into consideration the submissions advanced on behalf of both the parties

The case of the applicant is similar to that of co-accused Lalji Pandey, Kailash Mishra, Ram Naresh alias Bos and Chhota, therefore the applicant is also entitled for bail on the ground of parity.

.   Let the applicant Raju Mishra   indicted in case crime No.87  of 2005  under sections 307, 387, 506   I.P.C. , 10/12 of Dacoity Affected Area Act and 7 Criminal Law Amendment Act P.S.Bisanda  District Banda , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
