This is an application for bail moved on behalf of the applicant Shahjad indicted in case crime No. 1628 of 2006 under sections 380, 411, 457 I.P.C. P.S. Kotwali District Muzaffarnagar.
Heard Shri S.S. Pandey , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant was an employee of the complainant and he has been falsely implicated on demand of salary.
The learned A.G.A. argued that applicant was arrested at short distance from the spot and recovery of stolen articles was made from his possession.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about two months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Shahjad indicted in case crime No. 1628 of 2006 under sections 380, 411, 457 I.P.C. P.S. Kotwali District Muzaffarnagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
