This is an application for bail moved on behalf of the applicant Chhotey Lal indicted in case crime No. 330 of 2006 under section 306 I.P.C. P.S. Barkheda District Pilibhit.
Heard Shri Jitendra Pal Singh, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant's wife committed suicide by setting her to fire after pouring kerosene oil. The learned counsel pointed out that marriage had taken place eleven years before and couple had three children. The learned counsel urged that victim was taken to the hospital by the applicant. The learned counsel contended that there are no allegations of demand of dowry.
The learned A.G.A. argued that applicant was carrying illicit relationship with his sister-in-law(Bhabi) and thereby abetted to commission of suicide.
I have taken into consideration the submissions advanced on behalf of both the parties.
The marriage had taken place eleven years before and the deceased was mother of three children. She committed suicide by setting herself to fire. The victim was rushed to the hospital by the applicant. In the First Information Report the name of the woman with whom the applicant was carrying illicit relationship has not been mentioned. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Chhotey Lal indicted in case crime No. 330 of 2006 under section 306 I.P.C. P.S. Barkheda District Pilibhit , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
