This is an  application for bail moved on behalf of the applicant Kamlesh Verma   indicted in case crime No. 1207  of 2006  under sections 392, 411  I.P.C. P.S. Cantt.  District Gorakhpur .

Heard Shri S.B. Singh , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that applicant is a gold smith. The learned counsel urged that the looted ornaments are said to have been sold by the co-accused  Dinesh and others to the applicant.  The learned counsel contended that applicant had no knowledge that ornaments sold were looted property. The learned counsel urged that co-accused Rajkishore Kasaudhan has been granted bail by an order of this court dated 23.8.2006 passed in Criminal Misc. Bail Application No.17314 of 2006.

The learned A.G.A. argued that recovery of looted ornaments was made from the shop of the applicant at the pointing out of the co-accused.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant was not involved in the robbery. The stolen ornaments are said to have been sold to the applicant by the co-accused It is not clear whether the applicant had knowledge about the ornaments being stolen property. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Kamlesh Verma   indicted in case crime No. 1207  of 2006  under sections 392, 411  I.P.C. P.S. Cantt.  District Gorakhpur , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
