This is an application for bail moved on behalf of the applicant Nanhey indicted in case crime No. 588 of 2005 under section 365 I.P.C. P.S. Binwar District Badaun.
Heard Shri Vinay Saran , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that victim has been recovered and no ransom amount was demanded or paid. The learned counsel argued that applicant is in jail for the last about one year.
The learned A.G.A. argued that the recovery of victim was made from the possession of the applicant and co-accused.
I have taken into consideration the submissions advanced on behalf of both the parties.
The victim has been recovered and there was no demand of ransom. The applicant is in jail for the last about one year. There is no criminal history of the applicant. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Nanhey indicted in case crime No. 588 of 2005 under section 365 I.P.C. P.S. Binwar District Badaun , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
