This is an application for bail moved on behalf of the applicant Umesh indicted in case crime No. 479 of 2000 under sections 379 and 411 I.P.C. P.S. Uttar District Firozabad.
Heard Shri S.N. Yadav, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant was in jail in case no. 26 of 2001 under sections 395, 397 and 412 I.P.C. P.S. Etamadpur. The learned counsel submitted that fictitious recovery of stolen motorcycle has been made from the possession of the applicant. The learned counsel urged that applicant was arrested in compliance of non-bailable warrant.
The learned A.G.A. argued that recovery of stolen motorcycle was made at the pointing out of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovery of stolen motorcycle is said to have been made in the month January 2001. The applicant was in jail on 28.1..2001 in case No. 26 of 2001 under sections 395, 397 and 412 I.P.C. The applicant was arrested in the present case in the month of July 2006.In view of these facts, I consider it to be a fit case for bail.
Let the applicant Umesh indicted in case crime No. 479 of 2000 under sections 379 and 411 I.P.C. P.S. Uttar District Firozabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
