Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that there is a cross version of the alleged occurrence. From both the sides F.I.R. have been registered and both the sides received injuries. From the side of the prosecution one person lost his life and four persons received injuries and from the side of the applicants also one person lost his life and four persons received injuries. The injuries received by the applicants' side has not been explained. The prosecution has not come with clean hands.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Shiv Shankar and Raj Kumar involved in Case Crime No. 31-A of 2006, under Sections 147, 149, 302, 436, 323, and 504 I.P.C. Police Station Kotwali Dehat District Mirzapur be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
