We have heard learned counsel for the petitioners Sri Birendra Singh and Learned counsel for the respondents Sri H.P.Singh.

The petitioners have got a remedy of appeal against the notice-dated 7.2.2006  (Annexure 3 to the writ petition) under the provision of Rule 77 of the Mines and Minerals Concession Rules, 1963.

The writ petition is dismissed on the ground of alternative remedy. In case an appeal is filed within two weeks, the same shall be decided within a month thereafter.
