This application is filed by the applicant with a prayer that a direction may be issued the courts below for disposal of the bail application of the applicant expeditiously if possible on the same day in case crime no. 122 of 2005, under Section 419 I.P.C. P.S. Nagra, district Ballia.
It is contended that the allegation made against the applicant is not of grave in nature. He moved an application for surrender before the C.J.M. concerned and he himself appeared before the C.J.M. concerned, but the learned C.J.M. came to conclusion that the applicant is juvenile that is why the surrender was not taken by the court and it was directed to appear before a competent court vide order dated 7.9.2005. It is further contended that the applicant is a student. In case is sent to jail his carrier shall be spoiled.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 25 days from today and applies for bail his bail application shall be considered and disposed of expeditiously if possible on the same day keeping in mind that the applicant is a student and juvenile also.
With the above direction the application is finally disposed of.
