This is an application for bail moved on behalf of the applicant Manoj Kumar Rai indicted in case crime No. 63 of 2006 under section 2/3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Narahi District Ballia.
Heard Shri Ajay Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant is on bail in all the cases shown in the gang chart. The learned counsel pointed out that in four cases N.C.R. was registered whereas in two cases under section 307 I.P.c. no injuries were caused by the applicant.
The learned A.G.A. argued that applicant is a man of criminal antecedents and there is every likelihood of his committing other offences after being released on bail.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in all the cases shown in the gang chart , I consider it to be a fit case for bail.
Let the applicant Manoj Kumar Rai indicted in case crime No. 63 of 2006 under section 2/3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S Narahi District Ballia, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and subject to an undertaking that he will not misuse the liberty of bail by indulging in antisocial activities and commission of other offences.
