Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. After 10 days of the alleged occurrence an application was given in which the name of the applicant and other co-accused were disclosed. There is no other evidence against the applicant co-accused Devendra alias Bhola whose case is on the same footing has been released on bail by this court on 14.7.2006 in criminal misc. bail application no. 13952 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Shri Krishna alias Bansiwala involved in case crime no. 20 of 2006 under Sections 394,302,411 I.P.C., P.S. Dakshin District Firozabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
