Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the contesting respondent.
In view of order proposed to be passed, respondents have conceded that no counter affidavit is required.
The petitioner is aggrieved by an order passed by the Collector dated 7th August 2006 in a revision whereby stay application filed by the petitioner has been rejected. The aforesaid revision was filed against the order passed by Assistant Collector whereby direction has been given for eviction of the petitioner and damages to the tune of Rs.1,70,000/- has been imposed.
Without entering into the merits of the revision I direct that during the pendency of revision before the revisional authority the petitioner shall not be evicted from the land in dispute and realization of damages shall remain stayed. The revisional authority is directed to decide the revision within a period of three months from the date of presentation of a certified copy of this order.
With the aforesaid direction this writ petition is finally disposed of.
