The aforementioned Applications have been filed consequent to the death of Shyam Lal (defendant-respondent no.2).
Issue notice on the aforementioned Applications.
Miss. Merun Day holding brief for Shri A.N. Bhargava, Advocate states that Shri A.N. Bhargava has already filed his Vakalatnama on behalf of the defendants-respondents nos. 1/1 to 1/7 on 10.7.2006. The said Vakalatnama is not on the record.
Office is directed to trace the same, and place it on record.
Copies of the aforementioned Applications have already been served in the Office of Shri A.N. Bhargava, learned counsel for the defendants-respondents nos. 1/1 to 1/7. As such, notice need not be sent to the defendants-respondents nos. 1/1 to 1/7.
Notices will be issued to the proposed heir and legal representative of the defendant-respondent no.2 as well as to the remaining defendants-respondents by Registered Post A.D. fixing 10.1.2007.
Steps will be taken by the learned counsel for the plaintiff - appellant - applicant in the aforementioned Applications within eight weeks, failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.
