Dharm Raj Singh And Others v. The Commissioner And Others - WRIT - C No. 46025 of 2006 RD-AH 14772 (30 August 2006)
Civil Misc. Writ Petition No. 46025 of 2006
Dharm Raj Singh & Another .............Petitioners
The Commissioner Azamgarh Division, Azamgarh & Others...........Respondents
Hon'ble Krishna Murari, J.
Heard learned counsel for the petitioners.
Challenge in this writ petition has been made to the order dated 29.3.2006 passed by the Revisional Court admitting the revision filed by the petitioners themselves and directing the parties to maintain status quo. The petitioner has also challenged the order dated 2.3.2006 passed by respondent no. 2 rejecting their mutation application.
In so far as order dated 2.3.2006 is concerned the writ petition is not maintainable inasmuch as the petitioners are already availing alternative remedy and the revision filed by them challenging the said order has been admitted and is pending adjudication.
In so far as order dated 29.3.2006 is concerned, by the said order the revision filed by the petitioners has been admitted and a stay order directing the parties to maintain status quo has been passed.
I see no reason as to how the petitioners are aggrieved by an order by which their revision has been admitted for adjudication and a stay order has also been passed in their favour.
The writ petition appears to be totally misconceived and is hereby dismissed.
