Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the alleged occurrence has taken place on 10.10.2005 at about 5.45. Its F.I.R. was lodged on 10.10.2005 at about 9.10 p.m. It is alleged that the shot discharged by the co-accused Bhura hit the deceased and the shot discharged by the applicant hit the injured Sanjay Singh. The medical examination report of Sanjay Singh reveals that he has received two injuries. Both the injuries were simple in nature. The case of the applicant is distinguishable with the case of the other co-accused because he did not cause any injury on the person of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dinesh involved in case crime no. 312 of 2005 under Sections 302,307,323,506/34 I.P.C., P.S. Hathras Junction District Hathras be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
