Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was known to the first informant and other because he was residing at 500 yards from the alleged place of occurrence even then he was not named in the F.I.R. During investigation he was not named by any witness. It is alleged that from his possession three saries have been recovered. The saries were not bearing any specific mark to connect with the alleged offence. There is no other evidence against the applicant. The applicant is not having any criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Munib involved in case crime no. 255 of 2006 under Sections 302,394 and 411 I.P.C., P.S. Kapsethi District Varanasi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
