This is an application for bail moved on behalf of the applicant Nand Kishore indicted in case crime No.187 of 2006 under sections 323,498-A, 506 I.P.C. and 3/ 4 of Dowry Prohibition Act P.S. Gandhi park District Aligarh.
Heard Shri Dharmendra Singhal, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that there is no injury report of the applicant's wife. The learned counsel contended that general allegations of demand of motor cycle and harassment of the victim have been made against the applicant and co-accused.
The learned A.G.A. argued that applicant is the husband of the victim. The learned counsel submitted that there are allegations of demand of dowry and harassment of the victim for extortion of motorcycle.
I have taken into consideration the submissions advanced on behalf of both the parties
There is no injury report of the victim though allegations of subjecting her to assault have been made in the First Information Report. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Nand Kishore indicted in case crime No.187 of 2006 under sections 323,498-A, 506 I.P.C. and 3/ 4 of Dowry Prohibition Act P.S. Gandhi park District Aligarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
