Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the dead body of the deceased was recovered on 7.7.2006. Its information was given by the first informant to the police station concerned. Thereafter, the inquest report was prepared and post mortem examination was conducted. Thereafter, on 9.7.2006 the F.I.R. has been lodged alleging therein that the first informant was informed by his wife that the alleged occurrence was witnessed by the witnesses Prem Narain and Pappu. According to the statements Prem Narain and Pappu also the only evidence of last seen has come forward and there is no other evidence against the applicant and nothing incriminating was recovered from the possession of the applicant or his pointing out.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Pali involved in Case Crime No. 103 of 2006, under Sections 302 364,and 201I.P.C. Police Station Syana District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
